TERMS & CONDITIONS
These terms of use ("Terms") govern your use of the Frontier Direct Australia Pty Ltd (ABN 72 352935681) web site, frontierwines.com.au and any linked pages ("web site"). Your use of this web site will mean you accept these Terms.
- "Agreement" means an agreement between You and fontierwines.com.au to supply Goods. The Agreement consists of the Order and these Conditions.
- "Conditions" means these Conditions and any agreed written variations.
- "Delivery Address" means the address to which the Goods are to be delivered as stated on the Order.
- "Event" means a wine dinner, wine presentation or wine tour hosted by Frontier Wines
- "Goods" means Goods described in an Order and includes packaging.
- "Licensed Premises " means Frontier Wines Pty Ltd acting as agent Frontier Direct Pty Ltd's licensed premises at 42 Yarralea Street, Alphington, VIC - Licence No. 32053106.
- "Order" means an order by You to purchase Goods from .
- "Personal Details " includes, but is not limited to Your name, Delivery Address and payment details.
- "Product List" means the list of Goods displayed on the Frontier Wines website as amended from time to time.
- "Service Fee" means the fee payable to Frontier Wines in respect of delivery of the Goods and handling costs associated with processing your Order as advised by from time to time.
THE AGREEMENT
What is the Agreement?
The entire Agreement between You and frontierwines com.au for the purchase of Goods by You from frontierwines.com.au is:(a) these Conditions; and (b) the terms of the Order.
When the Agreement is formed
The Agreement exists between You and once frontierwines.com.au receives and accepts an order at its Licensed Premises. No obligation to sell or supply the Goods will arise until the order is received and accepted at Licensed Premises. Each Order is a separate agreement.
Set-Off
If You owe money to frontierwines.com.au under one agreement, frontierwines.com.au may set-off that money against any money that You owe to frontierwines.com.au under another agreement. If frontierwines.com.au owes money to You under one agreement frontierwines.com.au may set-off that money against any money that it owes You under another agreement.
Delivery Area
In order to purchase Goods from frontierwines.com.au, the Delivery Address which You nominate will need to be within a location where frontierwines.com.au provides delivery services. frontierwines.com.au will advise You if the Delivery Address which You nominate ceases to be in an area where frontierwines.com.au delivers goods. frontierwines.com.au will not be obliged to continue to deliver Goods to You if You change Your Delivery Address and the new Delivery Address which You nominate is not in an area within which frontierwines.com.au delivers goods.
Orders
You will place an order with frontierwines.com.au by:
- selecting Goods on frontierwines.com.au's website, entering your Personal Details and pressing the "submit for processing" button; or
- selecting Goods and instructing frontierwines.com.au by telephone that you wish to purchase the Goods, and providing your Personal Details to frontierwines.com.au; or
- selecting Goods and instructing frontierwines.com.au by facsimile that you wish to purchase the Goods, and providing your Personal Details to frontierwines.com.au; or
- selecting Goods and instructing frontierwines.com.au by e-mail that you wish to purchase the Goods, and providing your Personal Details to frontierwines.com.au; or
- selecting Goods and instructing frontierwines.com.au by regular mail that you wish to purchase the Goods, and providing your Personal Details to frontierwines.com.au.
Authorised receipt of Goods
Anyone at the Delivery Address who receives the Goods shall be presumed by frontierwines.com.au to be authorised to receive the Goods. frontierwines.com.au may request that the person who receives the Goods at the Delivery Address provide satisfactory evidence of proof of age. frontierwines.com.au will refuse to deliver the Goods if the person receiving the Goods is unable or unwilling to provide evidence of proof of age. The Goods will not be delivered to persons under the age of eighteen (18) years.
Delivery Requirements
frontierwines.com.au is required by law to give written instructions to the person responsible for delivery of the liquor, requiring that the liquor be delivered:
- to the adult person who placed the order, or
- to another adult person at those premises who undertakes to accept it on behalf of the person who placed the order, or
- if delivery takes place on a day following the placing of an order, in accordance with the customer's instructions but always to a person over the age of 18 years.
Risk and Title
Risk and title in the Goods passes to You upon delivery of the Goods to the Delivery Address.
Returns or Refunds
If at any time You are not satisfied with the quality of the Goods You have purchased, You may call the frontierwines.com.au office on 9443 0138 and a member of our team will assess Your request for a credit or refund of the purchase price.
Price of Goods & Purchases
The price You shall pay for the Goods shall be the price specified on the Product List. You also agree to pay the delivery and handling fee (when applicable) in respect of each Order.Variationfrontierwines.com.au's prices are subject to variation. The price payable for the Goods shall be the price applicable on the date the Goods are confirmed as ordered.Method of payment(a) Payment upon Placement of Order You shall pay for the Goods at the time of despatch of your Order. You may use your credit card (Bankcard, MasterCard, Visa, American Express) Cheques may be accepted at frontierwines.com.au's discretion.
Intellectual Property Rights
The material contained on this web site is protected by copyright. You may use this web site only for your personal and non-commercial purposes. Except to the extent permitted by relevant copyright legislation, you must not use, copy, modify, transmit, store, publish or distribute the material on this web site, or create any other material using material on this web site, without obtaining the prior written consent of frontierwines.com.au.
Trade marks (whether registered or unregistered) and logos must not be used or modified in any way without obtaining the prior written consent of Frontier Wines.
The web site, products, technology and processes contained in this web site may be the subject of other intellectual property rights owned by frontierwines.com.au or by third parties. No licence is granted in respect of those intellectual property rights other than as set out in these Terms. Your use of this web site must not in any way infringe the intellectual property rights of any person.
External Sites
This web site may contain links to, or frame, web sites of third parties ("external sites"). Frontier Wines is not required to maintain or update the links.
Links to, or framing of, external sites should not be construed as any endorsement, approval, recommendation or preference by Frontier Wines of the owners or operators of the external sites, or for any information, products or services referred to on the external sites unless expressly indicated on this web site.
Frontier Wines makes no warranties and accepts no liability in relation to material contained on external sites.
Security
When you use a shoping cart, a secure server is used. Secure Server Layer (SSL) encrypts the information you send through this web site. Frontier Wines makes no warranty in respect of the strength or effectiveness of that encryption and Frontier Wines is not responsible for events arising from unauthorised access of the information you provide.
Disclaimers and Limitation of Liability
Except where to do so would cause any part of these Terms to be illegal, void or unenforceable, Frontier Wines:
- Excludes all conditions and warranties implied into these Terms;
- To the fullest extent permitted by applicable law, is not liable to you or anyone else for any loss or damage, however caused (including negligence), which may be directly or indirectly suffered, in connection with use of this web site; and
- Excludes liability (whether that liability arises under contract, tort (including negligence) or statute) for any special, indirect or consequential loss or damage (including without limitation loss of revenue and loss of, or damage to, data) suffered or incurred in connection with this web site.
Without limiting the general disclaimer, Frontier Wines:
- Makes no warranty as to the completeness or accuracy of any material or as to its merchantability or fitness for a particular purpose. Frontier Wines is not liable to you or anyone else if errors occur in the information on this web site or if that information is not up-to-date;

Cancellations
Wine orders
Cancellations relating to wine orders must be received within 7 days of receipt of the initial order.
Events
Payments received for individual persons attending wine dinners or wine tours will only be refunded in full if notice is received at least 7 days prior to the event taking place. Unfortunately cancellations due to illness on the day of the event cannot be refunded.
Corporate Events
A 10% deposit is required to confirm the booking of a corporate event, with the balance paid at least 5 days prior to the event.
The complete cancellation of a confirmed corporate event within 14 days of the booked event, will result in the deposit being forfeited by the Company.
A reduction in the number of persons attending a booked event within 5 days of the date of the event, will result in full payment for the event.
General
Persons under 18 years of age are not permitted to place orders for alcohol.
